Fenland District Council promised to fight all the way to preserve planning permission given for a Sainsbury’s store in Whittlesey.
Faced with a legal challenge by a rival developer to build a Tesco store on an adjoining site, the council confirmed today it would go to court if necessary to defend its position.
Harrier Developments has begun the initial stages of a legal bid in the High Court has today issued the following rejection of their bid and the awarding of planning permission to Whitacre for a Sainsbury’s store and country park.
A Fenland Council spokesman said: “In consultation with leading counsel, Fenland District Council has filed an Acknowledgement of Service in the High Court in London stating that it will be contesting Harrier’s entire claim.
“We can confirm that Sainsbury’s will also be contesting the claim.
“The matter will now go before a Judge for him/her to decide if permission should be granted to seek a Judicial Review of the council’s decision to award planning permission for a supermarket at Whittlesey.
“Council officers will continue to work with leading Counsel to ensure that decision is robustly defended.”
