MAGISTRATES have discharged a case of sexual touching denied by a teacher at Neale-Wade Community College in March, because the Crown Prosecution Service failed to produce the necessary paperwork to progress the case.
Andrew Nicholson - currently suspended from his job - had earlier indicated a not guilty plea and was due to be committed for trial at Cambridge Crown Court.
But during proceedings yesterday at Wisbech courthouse, prosectuor Andrea Fawcett said the paperwork was not complete and she asked Fenland magistrates to adjourn the case for a further six weeks.
Nicholson’s solicitor Roger Glazebrook objected to the application to put off the committal hearing until August.
Nicholson, 52, of Park Road, Spalding, had been charged with touching a girl between the age of 13 and 17 in March on December 15 last year.
