INJUNCTIONS, prosecutions, stop notices, site visits and negotiation are all being used in Fenland's battle against unlawful building developments, says a new report.

Latest initiatives by the district council in at least 70 current enforcement cases have been prepared by Nigel Brown, the development services manager.

He will tell councillors on the planning committee next Wednesday of cases where there have been successful prosecutions, of cases where court action is imminent, and of cases where his officials continue to monitor breaches of planning laws.

Mr Brown says that some older cases have still not been resolved, specifically at Johnsted, High Road, Wisbech St Mary and Mile Tree Lane, Wisbech, which are "currently caught up in the prosecution cycle."

He said the case at Johnsted relates to an unauthorised change of use, where injunction action "is the best remedy to remove the breach. Due to non-appearance by the owner and ongoing adjournments this issue is becoming longstanding."

The case at Mile Tree Lane relates to a change of use for the stationing of caravans, in this case the owner has opted for trial at crown court.

"Whilst trial at crown court does allow for unlimited fines, it is a considerably longer process," said Mr Brown. "At the time of writing the issue is due back in court for the owner to be sentenced."

Mr Brown said the intervention of the courts highlights the delays and problems with pursuing enforcement issues.

"The criticisms do not necessarily rest with the courts themselves, but the judicial process by its nature can result in considerable delays."

Mr Brown said the council put forward such a strong case that the owners of Teelans, Oakdale Place, Wisbech, withdrew from a planning inquiry into their alleged unauthorised occupation of a travellers' site by non travellers.

And in Eldernell Lane, Coates, the owners of a home allegedly being built without consent have lodged an appeal against enforcement action.
